This Privacy Policy (the “Privacy Policy”) sets forth the online data collection, processing, storage, transfer, and usage policies and practices of Quativa Inc., a California corporation (“Quativa,” the “Company,” “us,” “we” and “our” are used interchangeably), and Quativa’s applications, mobile apps, websites, content, products, and services (collectively, the “Services”) that apply to you, the user, and, to the extent applicable, the customers that you contact (collectively, the “User” or “you”), and your use of the Services, as such term is defined in our Terms of Use (available at [INSERT LINK]) (the “Terms of Use”). By using or accessing the Services or any portion thereof, you accept the practices described in this Privacy Policy and our Terms of Use. Unless otherwise defined herein, capitalized terms set forth in this Privacy Policy shall have the meaning set forth in the Terms of Use. This policy does not apply to information collected through any other website, mobile application, service, or to the practices of companies that Quativa does not control. We are not responsible for the privacy practices of others or other websites, and we recommend that you read the privacy policies of each website and application that you visit and use. We respect the privacy of all Users of the Services, and unless otherwise set forth in this Privacy Policy or in any applicable Terms of Use, disclaimer, or legal statement related to the Services, we will not release your private Personal Information (defined in Section 2 below) without your permission, except as necessary to perform the Services.

“Personal Information” is unique information that identifies you. Personal Information includes information such as your name, mailing address, email address, telephone number[GC1] , and/or historic utility usage. Certain aspects of your Personal Information will be visible on the Services to your team members and/or team leaders[GC2] . Visible information may include your name, your email address, and your sales activity. All other Personal Information not described above will remain private and not available to your team members and/or salespeople on the Services. We may also ask you (or your customers) for financial information for payment purposes, including, but not limited to your billing name; billing address; credit, debit, bank card or PayPal/Stripe account information; or any other information that we, in our sole discretion, deem appropriate (“Payment Information”). We will not store your Payment Information on our database. Once you provide us with your Payment Information to us, we will forward the information to our third party payment processor, who will only use your Payment Information to process your payment of the ordered products. You can review and update your private Personal Information and Payment Information that you provide us by updating your profile. Please be aware that even after your request for a change to your Personal Information is processed, we may, for a time, retain residual information about you in backup and/or archival copies in our database. Additionally, you can also close your user account through the Services. If you close your Registered Account, we will remove your private Personal Information from our database[GC3] . However, please note that in the event you delete your account, we will retain any aggregated Non-Personal Information on our database.

Except as otherwise described in this Privacy Policy and the Terms of Use, we will not disclose private, confidential Personal Information to any third-party, unless we believe that disclosure is necessary to: (i) comply with the law, conform to legal requirements or to respond to a subpoena, search warrant or other legal process received by us, whether or not a response is required by applicable law; (ii) enforce the Terms of Use or any related agreement or to protect our rights, property, and interests (or of an affiliate); or (iii) protect the safety of members of the public and other Users. In addition, we disclose information to companies and individuals we employ or contract with to perform functions on our behalf. Examples include, but are not limited to, hosting our web servers, analyzing data, providing marketing assistance, processing payments for the ordered products and services, and conducting credit checks of you (when requested and authorized). These companies and individuals will only have access to your Personal Information as necessary to perform their functions, but they may not share that information with any other third party. We reserve the right to transfer or disclose your Personal Information to a successor in interest that acquires rights to that information as a result of (i) the sale of Quativa; (ii) a transfer of all or substantially all of our assets; or (iii) a transfer of the Services.

“Non-Personal Information” is information that does not specifically identify you or any person as an individual and includes, but is not limited to, such non-unique information obtained from Users of the Service like aggregated data, web-browser type, browsing history, IP address or an Internet Service Provider (“ISP”). Non-Personal Information is used to manage the Services; track usage and improve the Services; and is not linked to any Personal Information. Non-Personal Information may be shared with third parties to provide more relevant services to Users, and to enhance the Services.

Non-Personal Information may be collected about your usage of the Services or retrieved from your user account, if any, and aggregated with data from other Users. This aggregated anonymous data will not contain any Personal Information. Aggregate data is collected to build higher quality, more useful services by performing statistical analyses of the collective characteristics and behavior of Users of the Services. We may provide statistical information based on this data to advertisers and other current and potential business partners.

When you visit the Services we may receive the IP address of your mobile device, your mobile device’s operating system, and the name of your ISP. This information can be used to analyze overall trends to help us improve the Services. IP addresses may also be recorded for security and monitoring purposes as well as providing more relevant advertisements. The linkage between your IP address and your Personal Information is not shared with third parties without your permission unless otherwise required by law. We may access information about you from third-party sources and platforms[GC4] .

Quativa diligently makes every effort to ensure that your information is secure on its servers by using industry standard security technology, such as encryption and firewalls on both our main and backup servers. Unfortunately, information transmitted via the Internet is not completely secure. As a result, Quativa cannot guarantee the security of any information you transmit to us, and you do so at your own risk. We expressly disclaim any liability for any unauthorized access to or use of our secure servers and/or any and all Personal Information stored therein, and you agree to hold Quativa harmless for any loss or damages that may result therefrom.

The Services may contain links from which you may be able to visit third party websites. We may also carry advertisements from other companies. We are not responsible for the privacy practices of websites or other services operated by third parties that are linked from or integrated with the Service or for the privacy practices of third party Internet advertising companies. Once you leave the Services via such a link, access a third party application (such as widgets), you should check the applicable privacy policy of the third party or advertiser site to determine, among other things, how they will handle any Personal Information they collect from you.

Registered Users must be aged 18 years or older. We do not allow persons under age 18 to create a user account; nor do we knowingly collect or solicit Personal Information from anyone under the age of 18. In the event that we learn that information has been collected from a child under age 18, that information will be deleted as quickly as possible. If you believe that we might have any information from or about a child under age 18, please contact us. 

We reserve the right to, and may from time to time, make changes to this Privacy Policy. Any such changes will become effective immediately upon the posting to the Services, and the continued use of the Services by you after any changes have been made constitutes your acceptance of such changes. It is your responsibility to review this Agreement on a regular basis to determine if there have been any changes, which will be indicated by a revision to the effective date posted on the applicable webpage. You will be deemed to have accepted the Agreement as amended if you continue to use the Services after any amendments are posted on the Services. Nonetheless, in the event that any portion of this Privacy Policy is updated, Quativa has the right, but not the obligation, to notify you of such update via an electronic communication to the email address you registered when you created an account and/or a notice posted to the Services.

Quativa maintains its headquarters within and provides the Service from the United States. Please be aware that any information that we obtain as a result of your use of the Service will be subject to the laws of the United States. The privacy and data protection laws in the United States may not be equivalent to such laws in your country of residence. By accessing or using the Services, or any part of the Service, you consent to the collection, processing, storage, and transfer of your information to and within the United States. Quativa will take all steps reasonably necessary to ensure that your data is collected, processed, stored, and transferred in accordance with this Privacy Policy.
